Terms and Conditions for GoPractice

  1. Acceptance of Terms
    By downloading, installing, or using the GoPractice mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
  2. Description of Service
    GoPractice is a music practice application that provides:
    • Music practice tracking and progress monitoring
    • Metronome and rhythm training tools
    • Audio recording and playback features
    • Music reading exercises and tutorials
    • Practice session management
    • Referral and reward system
  3. User Accounts
    • Account Creation: You must create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and must provide accurate and complete information when creating your account.
    • Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
    • Age Requirements: We do not knowingly collect information from children under 13.
  4. Acceptable Use
    • Permitted Uses: Personal music practice and learning, educational purposes, non-commercial use, sharing your progress with friends and family.
    • Prohibited Uses: You may not use the App for any illegal or unauthorized purpose, violate laws, infringe on intellectual property, attempt unauthorized access, interfere with the App, use automated tools, share credentials, or create multiple accounts for abuse.
  5. User Content
    • Your Content: You retain ownership of content you create (recordings, practice data) but grant us a license to use it to provide the service. You are responsible for your content.
    • Content Guidelines: Content must not violate laws, infringe rights, contain harmful or inappropriate material, include others' personal info without consent, or be used for commercial purposes without permission.
  6. Intellectual Property
    • Our Rights: The App and its content are owned by us or our licensors. All trademarks, logos, and service marks are our property. You may not copy, modify, or distribute our intellectual property.
    • Third-Party Content: The App may include third-party music, sounds, and content, subject to their respective licenses and terms. You must comply with any third-party terms of use.
  7. Privacy and Data
    • Data Collection: We collect and process data as described in our Privacy Policy. By using the App, you consent to our data practices. You can control your privacy settings within the App.
    • Data Security: We implement reasonable security measures, but no method of transmission is 100% secure. You are responsible for protecting your device and data.
  8. Referral System
    • Referral Program: Users can earn rewards by referring friends. Referral codes are for personal use only. We reserve the right to modify or terminate the referral program.
    • Referral Rules: Referrals must be genuine. Users cannot create fake accounts for referrals. We may investigate and remove fraudulent referrals.
  9. Advertising
    • AdMob Integration: The App displays advertisements through Google AdMob. Ad content is controlled by Google and third-party advertisers. We are not responsible for ad content or targeting.
    • Ad-Free Access: Users may earn temporary ad-free access through referrals. Ad-free periods are subject to terms and conditions. We reserve the right to modify ad-free benefits.
  10. Subscription and Payments
    • Free Features: Basic features are available free of charge. Some features may require a subscription or payment.
    • Subscription Terms: Subscriptions are billed in advance. You can cancel subscriptions through your device settings. No refunds for partial subscription periods.
    • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
    • Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
    • Management: You can manage subscriptions in your App Store account settings.
    • Cancellation: You may cancel at any time through your App Store account settings.
    • Price Changes: We may change subscription prices with 30 days' notice.
    • Refunds: Refunds are subject to Apple's App Store refund policy.
  11. Disclaimers
    • Service Availability: We strive to maintain service availability but cannot guarantee 100% uptime. The App may be temporarily unavailable for maintenance. We are not liable for service interruptions.
    • Educational Content: The App provides educational content for music practice. We do not guarantee specific learning outcomes. Users should consult qualified music teachers for formal instruction.
    • Third-Party Services: The App integrates with third-party services (Google, Apple, Firebase). We are not responsible for third-party service availability or content. Third-party services have their own terms and privacy policies.
  12. Limitation of Liability
    • General Limitation: To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages, loss of data, profits, or business opportunities, damages arising from use of the App, or third-party actions or content.
    • Maximum Liability: Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
  13. Termination
    • Termination by You: You may stop using the App at any time.
    • Termination by Us: We may terminate or suspend your access if you violate these Terms, engage in fraudulent or abusive behavior, we discontinue the service, or as required by law.
    • Effect of Termination: Upon termination, your access will cease, we may delete your account and data, and some information may be retained for legal purposes.
  14. Changes to Terms
    • Updates: We may update these Terms from time to time.
    • Notification: We will notify you of material changes by posting the updated Terms in the App, sending you an email, or displaying a notice in the App.
    • Continued Use: Your continued use of the App after changes constitutes acceptance of the new Terms.
  15. Governing Law
    • Applicable Law: These Terms are governed by the laws of Switzerland.
    • Dispute Resolution: Any disputes shall be resolved through good faith negotiations, mediation (if required), or legal proceedings in Zurich, Switzerland.
  16. Special Provisions
    • Apple App Store: If you downloaded the App from the Apple App Store, Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims by you or third parties.
    • Google Play Store: If you downloaded the App from Google Play, Google is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims by you or third parties.
